1. Introduction

These Terms of Use ("Terms") govern your access to and use of the Magic Campus mobile application and related services (collectively, the "App" or "Services") operated by Fun City Innovations, LLC ("Fun City," "we," "our," or "us").

By downloading, accessing, or using the App, you ("User" or "you") acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as any applicable policies referenced herein, including our Privacy Policy.

If you do not agree to these Terms, you must not access or use the App.

Magic Campus is an integrated digital environment that includes:

• AI conversational agents
• Story feeds where users may upload videos or images
• IM-style chat
• Community spaces ("Spaces") for browsing and interaction

The App promotes an "AI for Good" philosophy and aims to create a safe, aligned, and meaningful interactive experience.

Certain features may evolve over time, and we reserve the right to introduce, modify, or remove functionalities as needed to improve or maintain the Services.

4. User Eligibility

To use the App, you must:

• Be at least 18 years old; or
• Use the App under the supervision of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.

Fun City may suspend or terminate accounts that appear to be used by minors without proper consent.

5. Account Registration and User Information

During onboarding, you will be asked to provide a nickname. After entering the App, you may optionally upload or modify:

• Profile photo
• Bio or introduction
• Other optional fields

You must ensure that all information you provide is accurate, lawful, and does not infringe upon any third party's rights.

You are responsible for safeguarding your account credentials and preventing unauthorized access.

6. User Obligations

By using the App, you agree to:

1. Use the App only for lawful, legitimate purposes.
2. Not upload or share any harmful, abusive, obscene, defamatory, or infringing content.
3. Not impersonate others or misrepresent your identity.
4. Not attempt to hack, disrupt, or interfere with the App or its services.
5. Not use automated tools, bots, or scripts unless expressly permitted.
6. Respect other users and refrain from harassment, threats, or harmful behaviors.

Violation of these obligations may result in suspension or permanent termination of your account.

7. User-Generated Content

7.1 Ownership and License

You retain ownership of the content you post ("User Content").

However, by uploading or publishing User Content within the App, you grant Fun City a non-exclusive, worldwide, royalty-free, sublicensable license to:

• Host, store, reproduce, display, or distribute your content
• Make your content available to other users
• Use your content to operate, improve, or promote the App

This license continues as long as your content remains within the App.

7.2 Your Responsibilities

You represent and warrant that:

• You own your User Content or have valid rights to share it
• Your content does not violate laws or third-party rights
• Your content is not harmful, exploitative, or illegal

We may remove or restrict User Content at our discretion to ensure safety and compliance.

8. AI-Generated Content

The App includes AI conversational agents that generate automated responses.

AI-generated content:

• Is not professional advice (financial, medical, legal, etc.)
• May not always be accurate or reliable
• Should be used for entertainment, reflection, or general information purposes only

You agree not to rely on AI outputs as factual or advisory.

9. Intellectual Property Rights

All intellectual property related to the App—including software, design, AI systems, graphics, features, and branding—is owned by Fun City or licensed to it.

You receive a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.

You may not:

• Copy, modify, or redistribute the App
• Reverse-engineer or attempt to extract source code
• Use App content for commercial purposes without written consent

Violation of IP rights may result in legal action.

10. Limitation of Liability

To the maximum extent permitted by law, Fun City is not liable for:

• Any damages resulting from your misuse of the App
• Any actions or content posted by other users
• Data loss, interruptions, errors, or technical failures
• Issues caused by network problems, force majeure, or unforeseeable events
• Any reliance on AI-generated content
• Harm caused by unauthorized access resulting from your failure to secure your device or account

You agree that your sole remedy for dissatisfaction with the App is to stop using the Services.

Fun City's total liability shall not exceed the amount paid by you for using the App in the 12 months preceding any claim (currently zero, as no subscription services are offered).

11. Termination and Suspension

Fun City may suspend or terminate your access to the App, with or without notice, if:

• You violate these Terms
• You engage in fraudulent or abusive behavior
• Your actions pose safety or legal risks
• Operating or legal requirements necessitate suspension

You may stop using the App at any time by deleting your account or uninstalling the App.

12. Modifications to the App and Terms

We may modify, update, or discontinue parts of the App at any time to support improvements, maintenance, or operational needs.

We may also update these Terms periodically. Continued use of the App after changes become effective constitutes acceptance of the revised Terms.

13. Communications and Notices

By using the App, you consent to receiving:

• Electronic communications
• Service notifications
• Emails regarding updates relevant to your use of the App

Notices will be deemed delivered once sent electronically.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-law rules.

For business entities, disputes shall be resolved in the courts located in Delaware.

For individual users, disputes will be handled under the applicable law and jurisdiction of your place of residence where required by consumer protection laws.
